The Supreme Court held that classifying a statute as substantive or procedural does not necessarily decide its retrospective applicability. It was hearing writ petitions and an interlocutory application involving a common legal question — the applicability of age restrictions on ‘intending couples’ under Section 4(iii)(c)(I) of the Surrogacy (Regulation) Act, 2021.
