Decree in favour of dead persons is nullity: SC
While restoring the execution proceedings in a case of property dispute, the Supreme Court has held that the decree passed by the first appellate Court, in an appeal, where both the appellants had expired prior to the appeal being heard, its decree in favour of dead persons would be a nullity. The Division Bench of Justice Pamidighantam Sri Narasimha and Justice Atul S Chandurkar held the decree.
