The power to declare war resides with India's President, but is exercised based on advice by Council of Ministers headed by the Prime Minister. Proclamation of Emergency, under Article 352 of the Constitution, in the event of a threat of war, is laid before both Houses of Parliament. The Houses must approve the proclamation by two-thirds majority within 30 days.
