Magistrate can directly order FIR registration: SC
The Supreme Court has held that a Magistrate is competent under Section 156(3) CrPC to direct the registration of an FIR if the allegations in the application/complaint disclose the commission of a cognizable offence, even if the informant has not exhausted the remedies. The Court also noted that ignoring the remedy under Section 154(3) amounts to mere procedural irregularity.
