Sec 405 IPC not attracted where property belongs to accused: SC
While quashing a criminal case relating to a property dispute, SN Vijayalakshmi v State Of Karnataka,
the Supreme Court has held that as per Sec 405 of the IPC, criminal breach of trust would arise only where the accused in any manner has been entrusted with property. The very foundation for invoking this provision will fall to the ground where the subject property belongs to the accused.
