The Supreme Court has ruled that the parties living apart does not necessarily mean a marriage has irretrievably broken down. The bench said courts must carefully assess who caused the separation and whether it was voluntary. It warned that hasty conclusions can harm children and urged family and high courts to analyse all facts and evidence thoroughly.
