Though impotence is not a ground for divorce but it still remains a ground for declaring a marriage as ‘null and void’. As per Section 12 Hindu Marriage Act, marriage can be declared as void if either of the spouses is impotent. Husband/wife can file a suit for declaration to declare their marriage as ‘null and void’, told the lawyer.
