The person possessing a thing isn't required to prove ownership; the burden is on the disputer. Section 113 of the Bhartiya Sakshya Adhiniyam states that when ownership is questioned in possession, the burden of proof that the possessor isn't the owner falls on the person claiming they are not the owner, as per Advocate Deepak Somani.
