The Supreme Court held that the Complainant under Section 138 of the Negotiable Instruments Act, 1881 qualifies as a victim and has a right to file an Appeal without seeking special leave. It said that in case of an offence alleged against an accused under Section 138, the Complainant is the victim owing to the alleged dishonour of a cheque.
