The Supreme Court has quashed an FIR registered under the Uttar Pradesh Gangsters & Anti-Social Activities (Prevention) Act, 1986, against the accused persons claiming to be members of a political party. The Court observed that the afterthought application of the Act, in absence of any subsequent criminal conduct, bears the hallmark of colorable exercise of power.
