The Supreme Court has held that non-submission of a Joint Venture Agreement cannot be a ground for disqualifying a bidder when the clause in the Notice Inviting Tender did not mandate its submission. The Court also stated that the conditions in a Notice Inviting Tender must be clear and unambiguous.
