The Supreme Court held that under Section 193 of CrPC, court of session can summon a person as accused to stand trial even if is not charge-sheeted by police and whose complexity in crime appears in the evidence available on record. It dismissed a plea against the Allahabad High Court’s order in an alleged murder and rape case.
