The Supreme Court has set aside a judgment of the NCLAT and held that the proviso to Section 61(2) of the IBC allows the Tribunal to permit the appeal to be filed even after expiry of the period of 30 days, if it is satisfied that there was sufficient cause, but such extended period should not exceed 15 days.
