When determining child custody, the court primarily considers child's welfare. However, if the father can prove that the mother lacks a suitable environment or is not financially or educationally qualified, the court may grant custody to the father. The Hon'ble Supreme Court has reiterated these principles in the case of Gaurav Nagpal verses Sumedha Nagpal 2009, told Advocate Deepak Somani.
