The Supreme Court held that a Foreign Award would not be automatically enforceable in India and the court must be satisfied that such an award is enforceable under Part-II Chapter-I of the Arbitration and Conciliation Act. It was hearing appeals under Section 62 of IBC by erstwhile promoters and various operational creditors of the corporate debtor against NCLAT’s judgment.
