While setting aside the order of suspension of sentence of a POCSO convict, the Supreme Court has observed that the High Court while hearing an application u/s 389 of CrPC for suspension of sentence is expected to examine prima facie existence of anything palpable on the record to indicate if the accused had a fair chance of overturning the conviction.
