The Supreme Court held that informing grounds of arrest to the arrestee is mandatory in all offences including the IPC/BNS and such grounds shall be communicated in writing at least 2 hours prior to the production of arrestee before the Magistrate. It further held that the said grounds must be communicated in writing to the arrestee in language he understands.
