The Supreme Court has terminated the mandate of the sole arbitrator nominated by the Managing Director of a Company. The Apex Court affirmed the view that a person ineligible for being appointed as an arbitrator cannot nominate a sole arbitrator. The appeals arose from an order rejecting the petition filed under Section 14(2) of the Arbitration and Conciliation Act.
