The Madras High Court held that phone-tapping constitutes a violation of the Right to Privacy unless justified by a procedure established by law. It allowed a writ petition against the order of the Secretary to Government of India, Ministry of Home Affairs, authorising tapping of the mobile phone by the Central Bureau of Investigation.
