The Supreme Court has dismissed a summoning order passed against P&G's former Non-Executive Director Shailyamanyu Singh under the Drugs & Cosmetics Act and observed that Section 34(2) begins with a caveat, that the prosecution has to provide proof regarding the active involvement of the Director in the affairs of the company which would justify drawing an inference about his/her inculpability.
