The Supreme Court refused to stay the abolishment of concept of 'Waqf by User' under Section 4(ix)(b) of the Waqf (Amendment) Act, 2025, saying that the same cannot be said to be arbitrary. It was hearing writ petitions, challenging the validity of several of the Sections of the Amendment Act on the ground of they being ultra vires the Constitution.
