The Supreme Court dismissed the appeals filed by the Commissioner of Service Tax, New Delhi, against a real estate partnership firm, stating that the transactions do not fall under the purview of a ‘Real Estate Agent’ under the Finance Act. The appeals had challenged a common judgment of the Customs, Excise and Service Tax Appellate Tribunal (CESTAT) in a service tax case.
