The Supreme Court has asked the Orissa High Court to assess the defects in the Form 25 affidavit in a petition filed against BJP MLA Tankadhar Tripathy’s election, alleging corrupt practices. The Court also reiterated that the requirement of filing an affidavit under the proviso to Section 83(1)(c) of the RP Act is not of a mandatory character.
