The Supreme Court has set aside the death sentence of a man who was accused of raping and killing a four-year-old minor girl in 2008 in Nagpur, Maharashtra. It held that Article 32 empowers the court to reopen the sentencing stage where the accused is condemned to death penalty without ensuring that the guidelines were followed.
