The Supreme Court observed that the court is bound to seek an explanation from the investigating agency if there is a large gap between the FIR and the culminating chargesheet and satisfy itself to the propriety of the explanation so furnished. It allowed an appeal of the accused against the Patna High Court’s judgment.
