The Supreme Court ruled that age restrictions under the Surrogacy (Regulation) Act do not apply to couples who began surrogacy before January 2022 by creating or freezing embryos. The Court noted that retrospective enforcement would violate couples' constitutional right to have a child. The exemption applies only to procedures already underway before the Act came into force.
