The Supreme Court said that a wife can claim maintenance even if she has not complied with the decree to cohabit, but only if she has a valid reason not to live with her husband. "There can be no hard and fast rule...and it must invariably depend on the distinctive facts and circumstances obtained in each case," SC said.
